During the discussion of the bill (Reg. No. 2156a) aimed at ensuring additional guarantees of implementing decisions of the European Court of Human Rights and the Constitutional Court of Ukraine, it was suggested to supplement chapter one of article 3 of the Criminal Code with new categories.
Following the results of the bill’s discussion, the Committee members, supporting the idea of creating preconditions for decreasing a number of applications to the European Court of Human Rights against Ukraine, voiced several remarks and suggestions to its content.At the meeting, it was stressed that according to provisions of articles 75 and 85 of the Constitution, a single body of legislative power in Ukraine is the Parliament, authorities of which include adopting laws. Thus, according to the Committee’s members, provision suggested by the author of the bill does not comply with legislatively determined competence of the Verkhovna Rada and the Constitutional Court of Ukraine.
